REGULAMIN REZERWACJI W DW POD JAWORAMI​ [PL}

SERWIS – strona internetowa www.podjaworami.com
REZERWACJA ONLINE – rezerwacja dokonywana w serwisie w czasie rzeczywistym zapomocą znajdującego się na stronie www.podjaworami.com silnika rezerwacyjnego.
GOŚĆ – osoba fizyczna albo osoba prawna, korzystająca z pokoju hotelowego napodstawie zawartej z Usługodawcą umowy na czasowe korzystanie z pokoju hotelowego.
POKÓJ – pokój lub apartament w obiekcie Dom Wczasowy Pod Jaworami, udostępniany Gościowi na czas pobytu zgodnie z ofertą.
OBIEKT – Dom Wczasowy Pod Jaworami, obiekt świadczący usługi hotelarskie w rozumieniu ustawy z dnia 29 sierpnia 1997 r. o usługach hotelarskich oraz usługach pilotów wycieczek i przewodników turystycznych, niebędący hotelem w rozumieniu tej ustawy.


Usługodawca:
Dom Wczasowy Pod Jaworami Elżbieta Para, 34-405 Białka Tatrzańska, ul. Środkowa 320, NIP 7361584492, będąca właścicielką Serwisu www.podjaworami.com i uprawniona do świadczenia Gościom, w zamian za ustalone wynagrodzenie, usług krótkotrwałego najmu Pokoi (dalej: „Usługodawca”).

 

§1

Postanowienia ogólne

1. Niniejsze Warunki rezerwacji (dalej: „Regulamin”) stanowią integralną część umowy krótkotrwałego najmu Pokoju zawartej między Gościem a Usługodawcą.
2. W ramach umowy najmu Usługodawca zobowiązuje się przygotować oraz udostępnić Pokój w uzgodnionym terminie, w zamian za ustalone wynagrodzenie.
3. Rezerwacji Pokoju można dokonywać na minimalny okres 1 (jednego) dnia, chyba że oferta w Serwisie stanowi inaczej.

Korzystanie przez dzieci z terenów rekreacyjnych jest
jednoznaczne z akceptacją poniższego regulaminu.

Korzystanie przez dziecko z terenów rekreacyjnych dostępnych na terenie Obiektu (w tym placu zabaw, pokoju zabaw i strefy relaksu) wymaga uprzedniej akceptacji poniższych postanowień przez rodzica lub opiekuna prawnego dziecka. Rodzic lub opiekun prawny, udostępniając dziecku tereny rekreacyjne, oświadcza, że:


1. wyraża zgodę na korzystanie przez dziecko z atrakcji dostępnych na terenie Obiektu;
2. zapoznał/a się i akceptuje treść regulaminów obowiązujących na terenie Obiektu, które są znane również dziecku, oraz zobowiązuje się – wraz z dzieckiem – do ich przestrzegania;
3. ma świadomość, że Obiekt nie świadczy usług opieki nad dziećmi i młodzieżą;
4. korzystanie przez dziecko z atrakcji odbywa się na wyłączne ryzyko rodzica/opiekuna, który w ramach obowiązku nadzoru nad dzieckiem odpowiada za wszelkie szkody przez nie spowodowane;
5. zna stan techniczny dostępnych atrakcji i nie zgłasza do nich zastrzeżeń; ma świadomość, że urządzenia takie jak domki dla dzieci czy piaskownica zostały wykonane metodą gospodarczą i nie posiadają atestów bezpieczeństwa;
6. dziecko nie ma przeciwwskazań zdrowotnych do korzystania z atrakcji oferowanych w Obiekcie oraz że korzystanie z nich wiąże się z ryzykiem urazu typowym dla rekreacyjnego uprawiania sportu; nieprzestrzeganie regulaminu i zasad bezpieczeństwa grozi wypadkiem, za który właściciele Obiektu nie ponoszą odpowiedzialności;
7. w zakresie dopuszczalnym przez obowiązujące przepisy prawa – w imieniu własnym oraz dziecka – zrzeka się roszczeń wobec właścicieli Obiektu z tytułu obrażeń, uszczerbku na zdrowiu lub szkody majątkowej powstałych w związku z korzystaniem przez dziecko z dostępnych atrakcji, z wyłączeniem szkód powstałych z winy umyślnej Usługodawcy, w zakresie, w jakim takie wyłączenie odpowiedzialności jest zgodne z bezwzględnie obowiązującymi przepisami prawa polskiego.

Uwaga: zrzeczenie się roszczeń nie obejmuje i nie może obejmować szkód wyrządzonych umyślnie oraz odpowiedzialności, której nie można wyłączyć lub ograniczyć na mocy bezwzględnie obowiązujących przepisów prawa (w tym Kodeksu cywilnego).

Zgoda na wykorzystanie wizerunku dziecka (odrębna, dobrowolna zgoda)
Wyrażenie zgody na korzystanie przez dziecko z terenów rekreacyjnych nie jest uzależnione od udzielenia zgody na wykorzystanie wizerunku dziecka. Zgoda na utrwalanie i wykorzystanie wizerunku dziecka (np. w materiałach promocyjnych Obiektu, mediach społecznościowych) jest odrębna, dobrowolna i wymaga osobnego złożenia odrębnego pisemnego oświadczenia, poprzez przesłanie wiadomości na adres kontakt@podjaworami.com. Brak takiej zgody nie ogranicza możliwości korzystania przez dziecko z atrakcji Obiektu. Zgoda może zostać cofnięta w każdym czasie ze skutkiem na przyszłość, poprzez przesłanie wiadomości na adres kontakt@podjaworami.com.

 

§2
Sposoby dokonywania rezerwacji

1. Niniejszy Regulamin stanowi integralną część umowy najmu Pokoju zawartej między Gościem a Usługodawcą.
2. Rezerwacji Pokoju Gość może dokonać w następujący sposób:


a) on-line, poprzez silnik rezerwacyjny dostępny na stronie www.podjaworami.com;
b) za pośrednictwem poczty elektronicznej, wysyłając wiadomość na adres: kontakt@podjaworami.com;
c) telefonicznie, pod numerem: +48 690 123 110;
d) osobiście w recepcji Obiektu (tzw. rezerwacja walk-in).


3. Rezerwację on-line albo rezerwację dokonaną za pośrednictwem poczty elektronicznej uważa się za dokonaną z chwilą nadania przez system rezerwacji on-line numeru potwierdzenia rezerwacji i otrzymania przez Gościa, na wskazany adres e-mail, potwierdzenia wraz z numerem rezerwacji oraz informacją o wymaganej przedpłacie. Otrzymanie potwierdzenia rezerwacji oznacza zawarcie umowy najmu między Usługodawcą a Gościem. W razie nieotrzymania potwierdzenia rezerwacji Gość powinien niezwłocznie skontaktować się z Usługodawcą.
4. Rezerwację złożoną telefonicznie uważa się za dokonaną z chwilą nadania przez Usługodawcę numeru potwierdzenia rezerwacji i otrzymania przez Gościa, na wskazany adres e-mail, potwierdzenia rezerwacji, po uprzednim dokonaniu zapłaty zgodnie z warunkami oferty. Otrzymanie potwierdzenia rezerwacji oznacza zawarcie umowy najmu między Usługodawcą a Gościem. W razie nieotrzymania potwierdzenia rezerwacji Gość powinien niezwłocznie skontaktować się z Usługodawcą.
5. Pokoje danego typu są usytuowane na różnych poziomach budynku. Rezerwacja nie oznacza wyboru pokoju na danym piętrze lub po danej stronie budynku, lecz rezerwację Pokoju danego typu, znajdującego się w Obiekcie.

 

§3
Opłaty i warunki płatności

1. Wysokość opłaty za zarezerwowany pobyt w Pokoju jest każdorazowo podana na stronie www.podjaworami.com po wybraniu odpowiedniej oferty lub na potwierdzeniu rezerwacji, w przypadku dokonania jej za pośrednictwem poczty elektronicznej lub telefonicznie.
2. Cena za rezerwację jest wyświetlana po wybraniu danej oferty i doliczeniu dodatków, jeżeli takie w danej ofercie występują i są obowiązkowe, lub jeżeli są opcjonalne i zostały wybrane przez Rezerwującego.
3. Opłaty podane są w złotych polskich (PLN) i objęte są stawką podatku od towarów i usług VAT według obowiązujących przepisów prawa podatkowego, tj. 8%.
4. Opłata za wynajem obejmuje koszt pobytu w Pokoju wskazanej w rezerwacji liczby osób.
5. Opłata za wynajem obejmuje usługi zgodne z ofertą i nie obejmuje kosztów usług dodatkowych zamówionych podczas pobytu.
6. Podczas dokonywania rezerwacji Gość zobowiązany jest, w zależności od oferty, wpłacić Usługodawcy zadatek w wysokości 30% wartości zarezerwowanego pobytu, o ile oferta nie stanowi inaczej. Wpłacona kwota stanowi zadatek w rozumieniu art. 394 Kodeksu cywilnego, chyba że oferta wyraźnie stanowi inaczej.
7. Pozostałą część opłaty za zarezerwowany pobyt Gość uiszcza na miejscu, w dniu przyjazdu.
8. Oferta jest zwrotna, o ile Gość dokona anulacji rezerwacji nie później niż 30 dni przed rozpoczęciem pobytu, chyba że oferta stanowi inaczej lub Gość wybrał opcję oferty bezzwrotnej.
9. W przypadku zgubienia klucza/chipa do Pokoju lub kluczyka do narciarni należy niezwłocznie poinformować o tym obsługę. Opłata za zgubioną kartę lub kluczyk wynosi 30 zł.

§4
Zmiana oraz anulowanie rezerwacji

 

1. Zmiana terminu rezerwacji lub kategorii Pokoju jest możliwa wyłącznie pod warunkiem dostępności Pokoju we wskazanym terminie oraz dokonania opłaty różnicy w cenie za pobyt, o ile taka występuje.
2. Zmiana rezerwacji przez Usługodawcę jest możliwa wyłącznie w przypadku wystąpienia siły wyższej, uniemożliwiającej spełnienie świadczenia. Przez siłę wyższą rozumie się w szczególności: strajki, wojny, zamieszki, kataklizmy przyrody, zajęcie Pokoju przez organ władzy publicznej w jakimkolwiek celu oraz pozbawienie dostaw mediów (prądu, gazu, energii cieplnej lub wody) w Pokoju. W takim przypadku Usługodawca zobowiązany jest zaproponować Gościowi inny termin lub odstąpić od umowy, zwracając wpłaconą opłatę za zarezerwowany pobyt.
3. W wyjątkowych sytuacjach, w szczególności w razie awarii Pokoju lub innego zdarzenia losowego, Usługodawca zastrzega sobie możliwość udostępnienia innego Pokoju o parametrach i powierzchni podobnych do zarezerwowanego. W przypadku braku akceptacji zmiany przez Gościa umowa ulega rozwiązaniu, a Usługodawca zwraca Gościowi wpłaconą opłatę za zarezerwowany pobyt.

§5
Pobyt

1. Pobyt rozpoczyna się o godzinie 16:00 w pierwszym dniu zarezerwowanego terminu. Zakończenie pobytu następuje o godzinie 11:00 w ostatnim dniu zarezerwowanego terminu. Gość zobowiązany jest zwrócić klucz do Pokoju pracownikowi recepcji.
2. Goście zobowiązani są do przestrzegania godzin ciszy nocnej oraz zasad BHP i ochrony przeciwpożarowej obowiązujących w Obiekcie. W godzinach od 22:00 do 8:00 zabronione są wszelkie zachowania zakłócające ciszę nocną.
3. Gość powinien powiadomić o zauważonych usterkach lub uszkodzeniach w dniu przyjazdu. W przypadku uszkodzeń powstałych w trakcie pobytu Gość zostanie obciążony kosztami naprawy lub wymiany uszkodzonego sprzętu.
4. Gość ponosi pełną odpowiedzialność materialną za wszelkiego rodzaju uszkodzenia lub zniszczenia wyposażenia i urządzeń technicznych Pokoju, powstałe z jego winy lub z winy osób go odwiedzających.
5. Gość zobowiązuje się dopilnować, aby liczba osób przebywających wraz z nim w Pokoju nie przekraczała liczby określonej jako maksymalna w Serwisie lub na potwierdzeniu rezerwacji. Osoby zaproszone zobowiązane są opuścić Pokój przed godziną 22:00.
6. Gość zobowiązuje się nie przetrzymywać zwierząt w Pokoju, chyba że w danym Pokoju zwierzęta są akceptowane i Gość uiścił opłatę za zwierzę.
7. Korzystanie z pokoju zabaw oraz placu zabaw jest bezpłatne. Korzystanie ze strefy relaksu (w tym basenu, sauny i jacuzzi) jest odpłatne, zgodnie z cennikiem dostępnym w Serwisie lub w recepcji Obiektu. W przypadku niemożności skorzystania z którejkolwiek z ww. atrakcji z powodu awarii lub innych przyczyn niezależnych od Usługodawcy, Gościowi nie przysługuje prawo do obniżenia ceny rezerwacji ani zwrotu poniesionych opłat.
8. Palenie w Pokojach jest całkowicie zabronione. Gość nieprzestrzegający tego zakazu zostanie obciążony opłatą w wysokości 800 PLN (osiemset złotych) lub 200 EUR (dwieście euro) tytułem pokrycia kosztów prania m.in. zasłon, dywanów oraz narzut w Pokoju.
9. W przypadku naruszenia zasad określonych w Regulaminie Usługodawca ma prawo potrącić z pobranego depozytu m.in.: wynagrodzenie należne za pobyt osoby niezgłoszonej oraz koszty doprowadzenia Pokoju do stanu pierwotnego. Jeżeli wartość roszczeń przekracza wartość depozytu, Gość zobowiązany jest niezwłocznie pokryć różnicę.
10. W przypadku rażącego naruszenia zasad określonych w Regulaminie, nieprzestrzegania ciszy nocnej, wulgarnego zachowania wobec personelu lub innych Gości, Usługodawca ma prawo wypowiedzieć umowę ze skutkiem natychmiastowym i usunąć Gościa wraz z osobami towarzyszącymi z Pokoju.


§6
Reklamacje

1. Gość ma prawo do złożenia reklamacji usługi i dochodzenia roszczeń z tego tytułu, stosownie do właściwych przepisów prawa.
2. Warunkiem rozpatrzenia reklamacji jest jej zgłoszenie w formie pisemnej na adres siedziby Usługodawcy lub w formie elektronicznej na adres kontakt@podjaworami.com.
3. Reklamacje zostaną rozpatrzone w terminie 30 dni od dnia ich otrzymania. Informacja o sposobie rozpatrzenia reklamacji zostanie przesłana Gościowi na wskazany przez niego adres korespondencyjny lub adres e-mail.

 


PRZETWARZANIE DANYCH OSOBOWYCH

Zgodnie z art. 13 rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (dalej: „RODO”), informujemy, że:


1. Administrator danych
Administratorem danych osobowych Gości jest Dom Wczasowy Pod Jaworami Elżbieta Para, 34-405 Białka Tatrzańska, ul. Środkowa 320, NIP 7361584492, adres e-mail: kontakt@podjaworami.com (dalej: „Administrator”).


2. Cele i podstawy prawne przetwarzania
Dane osobowe Gościa przetwarzane są w następujących celach:


a) zawarcia i wykonania umowy najmu (obsługa procesu rezerwacji, zameldowanie, realizacja pobytu, rozliczenie płatności) – na podstawie art. 6 ust. 1 lit. b) RODO;
b) wypełnienia obowiązków prawnych ciążących na Administratorze, w tym obowiązków podatkowych, rachunkowych oraz wynikających z przepisów o opłacie miejscowej/uzdrowiskowej – na podstawie art. 6 ust. 1 lit. c) RODO;
c) ustalenia, dochodzenia lub obrony przed roszczeniami oraz zapewnienia bezpieczeństwa osób i mienia na terenie Obiektu – na podstawie prawnie uzasadnionego interesu Administratora, tj. art. 6 ust. 1 lit. f) RODO;
d) rozpatrywania reklamacji – na podstawie art. 6 ust. 1 lit. b) i c) RODO;
e) marketingu bezpośredniego oraz wykorzystania wizerunku (w tym wizerunku dziecka) – wyłącznie na podstawie odrębnej, dobrowolnej zgody Gościa, tj. art. 6 ust. 1 lit. a) RODO.


3. Okres przechowywania danych


a) Dane zbierane w związku z rezerwacją i realizacją umowy najmu przechowywane są przez czas trwania umowy, a następnie przez okres przedawnienia ewentualnych roszczeń wynikających z umowy. 
b) Dane zawarte na dokumentach księgowych (fakturach, rachunkach) przechowywane są przez okres wymagany przepisami prawa podatkowego i o rachunkowości, co do zasady 5 lat licząc od końca roku kalendarzowego, w którym powstał obowiązek podatkowy.
c) Dane zbierane na papierowej karcie Gościa (karcie meldunkowej) wypełnianej przy zameldowaniu przechowywane są wyłącznie przez czas trwania pobytu Gościa, w miejscu o ograniczonym dostępie. Karta jest niszczona niezwłocznie po zakończeniu pobytu (w dniu wymeldowania), przy użyciu niszczarki tnącej w sposób uniemożliwiający odtworzenie danych. Jeżeli dane z karty (np. imię, nazwisko, adres) są niezbędne do wystawienia faktury lub rachunku, odpowiednia część danych zostaje przeniesiona do dokumentacji księgowej i przechowywana zgodnie z pkt b) powyżej – pozostała treść karty ulega zniszczeniu.
d) Dane przetwarzane na podstawie zgody (marketing, wizerunek) przechowywane są do czasu cofnięcia zgody.


4. Odbiorcy danych
Dane osobowe Gościa mogą być udostępniane następującym kategoriom odbiorców:


a) Hotres.pl (LEMONPIXEL.pl Roman Korczyński, ul. Młyńska 12A, 58-570 Jelenia Góra) – jako podmiot przetwarzający dane osobowe na zlecenie Administratora, na podstawie umowy powierzenia przetwarzania danych osobowych zawartej zgodnie z art. 28 RODO;
b) podmioty obsługujące płatności online;
c) biuro rachunkowe obsługujące Administratora;
d) podmioty uprawnione do otrzymania danych na podstawie przepisów prawa.


Dane osobowe Gościa nie są przekazywane do państw trzecich (poza Europejski Obszar Gospodarczy) ani do organizacji międzynarodowych.


5. Prawa osoby, której dane dotyczą
Gościowi przysługuje prawo do: dostępu do treści swoich danych, ich sprostowania, usunięcia, ograniczenia przetwarzania, przenoszenia danych, wniesienia sprzeciwu wobec przetwarzania opartego na art. 6 ust. 1 lit. f) RODO, a także – w zakresie danych przetwarzanych na podstawie zgody – cofnięcia zgody w dowolnym momencie, bez wpływu na zgodność z prawem przetwarzania dokonanego przed jej cofnięciem.


Powyższe uprawnienia można zrealizować poprzez przesłanie wiadomości na adres e-mail: kontakt@podjaworami.com.
Gościowi przysługuje również prawo wniesienia skargi do organu nadzorczego – Prezesa Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa – jeżeli uzna, że przetwarzanie jego danych osobowych narusza przepisy RODO.

 

6. Dobrowolność podania danych
Podanie danych osobowych przez Gościa jest dobrowolne, jednak niezbędne do dokonania rezerwacji oraz zawarcia i wykonania umowy najmu. Niepodanie danych uniemożliwia realizację rezerwacji.


7. Zautomatyzowane podejmowanie decyzji
Dane osobowe Gościa nie są przetwarzane w sposób zautomatyzowany, w tym w formie profilowania, wywołującego wobec Gościa skutki prawne lub w podobny sposób istotnie na niego wpływający.


8. Zobowiązania Administratora


1. Administrator dokłada należytej staranności, aby dane osobowe Gościa nie były udostępniane osobom nieuprawnionym, i w tym zakresie stosuje odpowiednie środki techniczne i organizacyjne.
2. Administrator zachowuje prawo udostępnienia danych osobowych podmiotom upoważnionym (podprocesorom) oraz w przypadkach przewidzianych przepisami prawa powszechnie obowiązującego, w szczególności podmiotom realizującym płatności online oraz dostawcom oprogramowania recepcyjnego.
3. Administrator zobowiązany jest do zachowania w tajemnicy i poufności informacji uzyskanych w związku z realizacją procesu rezerwacji. Zobowiązanie to pozostaje w mocy bezterminowo.


9. Zobowiązania Hotres.pl
Hotres.pl, jako podmiot przetwarzający dane osobowe Gościa na podstawie umowy powierzenia przetwarzania danych zawartej z Administratorem zgodnie z art. 28 RODO, zobowiązany jest w szczególności do: wdrożenia odpowiednich środków technicznych i organizacyjnych zapewniających stopień bezpieczeństwa odpowiadający ryzyku przetwarzania; szyfrowania transmisji danych osobowych; zapewnienia poufności, integralności, dostępności i odporności systemów i usług przetwarzania; zdolności do szybkiego przywrócenia dostępności danych osobowych w razie incydentu fizycznego lub technicznego; oraz regularnego testowania i oceniania skuteczności stosowanych środków bezpieczeństwa.

 

POSTANOWIENIA KOŃCOWE


Administrator jest uprawniony do wprowadzenia zmian w postanowieniach Regulaminu, w szczególności w przypadku:
1. konieczności dostosowania Regulaminu do bezwzględnie obowiązujących przepisów prawa lub do zmian tych przepisów;
2. konieczności dostosowania Regulaminu do zalecenia, interpretacji, orzeczenia, postanowienia lub decyzji uprawnionego organu władzy publicznej lub sądu, mających wpływ na treść Regulaminu;
3. rozbudowy lub zmiany funkcjonalności Hotres.pl.
Zmiany Regulaminu nie mają wpływu na warunki rezerwacji dokonanych przed dniem wejścia w życie zmiany, chyba że zmiana wynika z bezwzględnie obowiązujących przepisów prawa.

Reservation Terms and Conditions [EN]

SERVICE – the website www.podjaworami.com.

ONLINE RESERVATION – a reservation made through the Service in real time using the booking engine available on www.podjaworami.com.

GUEST – a natural person or legal entity using a Room on the basis of an agreement concluded with the Service Provider for the temporary use of a hotel room.

ROOM – a room or apartment in the Dom Wczasowy Pod Jaworami facility, made available to the Guest for the duration of their stay in accordance with the offer.

FACILITY – Dom Wczasowy Pod Jaworami, a facility providing hospitality services within the meaning of the Act of 29 August 1997 on Hospitality Services and the Services of Tour Guides and Tour Leaders, which is not a "hotel" within the meaning of that Act.

Service Provider:

Dom Wczasowy Pod Jaworami Elżbieta Para, 34-405 Białka Tatrzańska, ul. Środkowa 320, Tax ID (NIP) 7361584492, owner of the Service www.podjaworami.com and authorized to provide Guests, in exchange for an agreed fee, with short-term rental services for Rooms (hereinafter: the "Service Provider").

§1 General Provisions

  1. These Reservation Terms (hereinafter: the "Terms") form an integral part of the short-term Room rental agreement concluded between the Guest and the Service Provider.

  2. Under the rental agreement, the Service Provider undertakes to prepare and make the Room available on the agreed date, in exchange for an agreed fee.

  3. A Room may be reserved for a minimum period of 1 (one) day, unless the offer in the Service states otherwise.

Use of recreational areas by children is equivalent to acceptance of the terms below.

Use by a child of the recreational areas available on the Facility's premises (including the playground, the play room, and the relaxation zone) requires prior acceptance of the following provisions by the child's parent or legal guardian. A parent or legal guardian, by allowing a child to use the recreational areas, declares that they:

  1. consent to their child using the attractions available on the Facility's premises;

  2. have read and accept the content of the rules in force on the Facility's premises, which are also known to the child, and undertake — together with the child — to comply with them;

  3. are aware that the Facility does not provide childcare or supervision services for children and minors;

  4. understand that their child's use of the attractions is at the sole risk of the parent/guardian, who, as part of their duty of supervision over the child, is responsible for any damage caused by the child;

  5. are aware of the technical condition of the available attractions and raise no objections to them; are aware that play equipment such as playhouses or sandboxes were built using non-commercial (self-build) methods and do not hold safety certification;

  6. confirm that the child has no health contraindications to using the attractions offered at the Facility, and that using them carries a risk of injury typical of recreational sports activity; failure by the child to follow the Facility's rules and safety guidelines may result in an accident for which the Facility's owners bear no liability;

  7. to the extent permitted by applicable law — on their own behalf and on behalf of the child — waive claims against the Facility's owners for injury, harm to health, or property damage arising in connection with the child's use of the available attractions, excluding damage caused by the Service Provider's intentional fault, to the extent such exclusion of liability is consistent with mandatory provisions of Polish law.

Note: this waiver of claims does not, and cannot, cover damage caused intentionally, nor liability that cannot be excluded or limited under mandatory provisions of law (including the Polish Civil Code).

Consent to use of a child's image (separate, voluntary consent)

Consent to a child using the recreational areas is not conditional on granting consent to use of the child's image. Consent to recording and using a child's image (e.g., in the Facility's promotional materials or on social media) is separate, voluntary, and requires a separate written statement, to be submitted by sending a message to kontakt@podjaworami.com. Absence of such consent does not limit the child's ability to use the Facility's attractions. Consent may be withdrawn at any time, with future effect, by sending a message to kontakt@podjaworami.com.

§2 Methods of Making a Reservation

  1. These Terms form an integral part of the Room rental agreement concluded between the Guest and the Service Provider.

  2. A Guest may make a Room reservation as follows: a) online, via the booking engine available at www.podjaworami.com; b) by email, by sending a message to: kontakt@podjaworami.com; c) by telephone, at: +48 690 123 110; d) in person, at the Facility's front desk (a so-called "walk-in" reservation).

  3. An online reservation, or one made by email, is deemed made once the online reservation system issues a reservation confirmation number and the Guest receives, at the email address provided, confirmation together with the reservation number and information on the required prepayment. Receipt of the reservation confirmation constitutes conclusion of the rental agreement between the Service Provider and the Guest. If the Guest does not receive a reservation confirmation, they should promptly contact the Service Provider.

  4. A reservation made by telephone is deemed made once the Service Provider issues a reservation confirmation number and the Guest receives, at the email address provided, a reservation confirmation, following prior payment in accordance with the terms of the offer. Receipt of the reservation confirmation constitutes conclusion of the rental agreement between the Service Provider and the Guest. If the Guest does not receive a reservation confirmation, they should promptly contact the Service Provider.

  5. Rooms of a given type are located on different floors of the building. A reservation therefore does not constitute selection of a room on a specific floor or a specific side of the building, but rather a reservation of a Room of the given type available at the Facility.

§3 Fees and Payment Terms

  1. The fee for a reserved stay in a Room is stated in each case on the website www.podjaworami.com after selecting the relevant offer, or on the reservation confirmation if the reservation was made by email or telephone.

  2. The reservation price is displayed after selecting the relevant offer and adding any extras, where such extras exist within the offer and are mandatory, or are optional and have been selected by the person making the reservation.

  3. Fees are stated in Polish złoty (PLN) and are subject to VAT at the applicable statutory rate, i.e., 8%.

  4. The rental fee covers the cost of the stay in the Room for the number of persons specified in the reservation.

  5. The rental fee covers services in accordance with the offer and does not cover the cost of additional services ordered during the stay.

  6. When making a reservation, the Guest is required, depending on the offer, to pay the Service Provider a deposit of 30% of the value of the reserved stay, unless the offer states otherwise. The amount paid constitutes a "zadatek" (earnest money deposit) within the meaning of Article 394 of the Polish Civil Code, unless the offer expressly states otherwise.

  7. The Guest pays the remaining balance for the reserved stay on site, on the day of arrival.

  8. The offer is refundable provided the Guest cancels the reservation no later than 30 days before the start of the stay, unless the offer states otherwise or the Guest selected a non-refundable offer option.

  9. In the event of loss of the room key/chip or the ski-room key, staff must be informed immediately. The fee for a lost card or key is PLN 30.

§4 Changes and Cancellation of Reservations

  1. A change to the reservation date or Room category is possible only subject to Room availability on the requested date and payment of any price difference for the stay, if applicable.

  2. A change to the reservation by the Service Provider is possible only in the event of force majeure preventing performance of the service. Force majeure means, in particular: strikes, wars, riots, natural disasters, seizure of the Room by any public authority for any purpose, and loss of utility supply (electricity, gas, heating, or water) to the Room. In such a case, the Service Provider must offer the Guest an alternative date or withdraw from the agreement, refunding the amount paid for the reserved stay.

  3. In exceptional circumstances, in particular in the event of a Room malfunction or other unforeseen event, the Service Provider reserves the right to provide an alternative Room of similar parameters and size to the one reserved. If the Guest does not accept the change, the agreement is terminated, and the Service Provider must refund the Guest the amount paid for the reserved stay.

§5 Stay

  1. The stay begins at 4:00 PM on the first day of the reserved period. The stay ends at 11:00 AM on the last day of the reserved period. The Guest must return the Room key to front-desk staff.

  2. Guests must observe quiet hours as well as the Facility's health, safety, and fire-safety rules. Between 10:00 PM and 8:00 AM, all behavior disturbing quiet hours is prohibited.

  3. The Guest should report any noticed defects or damage on the day of arrival. In the case of damage occurring during the stay, the Guest will be charged the cost of repair or replacement of the damaged equipment.

  4. The Guest bears full financial liability for any damage to or destruction of the Room's furnishings and technical equipment caused through their own fault or that of their visitors.

  5. The Guest must ensure that the number of persons staying with them in the Room does not exceed the maximum specified in the Service or on the reservation confirmation. Invited guests must leave the Room before 10:00 PM.

  6. The Guest undertakes not to keep animals in the Room, unless animals are permitted in the given Room and the Guest has paid the applicable pet fee.

  7. Use of the play room and the playground is free of charge. Use of the relaxation zone (including the pool, sauna, and jacuzzi) is subject to a fee, in accordance with the price list available in the Service or at the Facility's front desk. If the Guest is unable to use any of the above attractions due to a malfunction or other reasons beyond the Service Provider's control, the Guest is not entitled to a reduction in the reservation price or a refund of fees already paid.

  8. Smoking in the Rooms is strictly prohibited. A Guest who fails to comply with this prohibition will be charged a fee of PLN 800 (eight hundred złoty) or €200 (two hundred euro) to cover the cost of laundering, among other things, curtains, carpets, and bedspreads in the Room.

  9. In the event of a breach of the rules set out in these Terms, the Service Provider is entitled to deduct from the deposit collected, among other things: the fee due for the stay of an unregistered person and the cost of restoring the Room to its original condition. If the value of the claims exceeds the value of the deposit, the Guest must promptly cover the difference.

  10. In the event of a serious breach of the rules set out in these Terms, failure to observe quiet hours, or abusive behavior toward staff or other Guests, the Service Provider is entitled to terminate the agreement with immediate effect and remove the Guest, together with any accompanying persons, from the Room.

§6 Complaints

  1. The Guest has the right to file a complaint regarding the service and to pursue claims on that basis, in accordance with applicable law.

  2. A complaint will only be considered if submitted in writing to the Service Provider's registered address, or electronically to kontakt@podjaworami.com.

  3. Complaints will be resolved within 30 days of receipt. Information on the outcome will be sent to the Guest at the postal or email address provided by them.

PROCESSING OF PERSONAL DATA

In accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: "GDPR"), we inform you that:

1. Data Controller

The controller of Guests' personal data is Dom Wczasowy Pod Jaworami Elżbieta Para, 34-405 Białka Tatrzańska, ul. Środkowa 320, Tax ID (NIP) 7361584492, email: kontakt@podjaworami.com (hereinafter: the "Controller").

2. Purposes and Legal Bases for Processing

Guest personal data is processed for the following purposes:

a) concluding and performing the rental agreement (handling the reservation process, check-in, the stay, and payment settlement) — under Article 6(1)(b) GDPR; b) fulfilling legal obligations imposed on the Controller, including tax and accounting obligations and obligations arising from local/resort tax regulations — under Article 6(1)(c) GDPR; c) establishing, pursuing, or defending against claims, and ensuring the safety of persons and property on the Facility's premises — on the basis of the Controller's legitimate interest, i.e., Article 6(1)(f) GDPR; d) handling complaints — under Article 6(1)(b) and (c) GDPR; e) direct marketing and use of image rights (including a child's image) — solely on the basis of the Guest's separate, voluntary consent, i.e., Article 6(1)(a) GDPR.

3. Data Retention Period

a) Data collected in connection with the reservation and performance of the rental agreement is retained for the duration of the agreement, and thereafter for the limitation period applicable to any claims arising from the agreement. b) Data contained in accounting documents (invoices, receipts) is retained for the period required under tax and accounting law, generally 5 years from the end of the calendar year in which the tax obligation arose. c) Data collected on the paper Guest registration card completed at check-in is retained only for the duration of the Guest's stay, in a location with restricted access. The card is destroyed promptly after the stay ends (on the day of check-out), using a cross-cut shredder in a manner that prevents reconstruction of the data. If data from the card (e.g., name, address) is required to issue an invoice or receipt, the relevant portion of the data is transferred to the accounting records and retained in accordance with point b) above — the remaining content of the card is destroyed. d) Data processed on the basis of consent (marketing, image rights) is retained until consent is withdrawn.

4. Recipients of Data

Guest personal data may be shared with the following categories of recipients:

a) Hotres.pl (LEMONPIXEL.pl Roman Korczyński, ul. Młyńska 12A, 58-570 Jelenia Góra) — as a data processor acting on the Controller's behalf, under a data processing agreement concluded pursuant to Article 28 GDPR; b) online payment providers; c) the accounting firm servicing the Controller; d) entities authorized to receive data under applicable law.

Guest personal data is not transferred to third countries (outside the European Economic Area) or to international organizations.

5. Rights of the Data Subject

The Guest has the right to: access their data, rectify it, erase it, restrict its processing, data portability, object to processing based on Article 6(1)(f) GDPR, and — with respect to data processed on the basis of consent — withdraw consent at any time, without affecting the lawfulness of processing carried out before its withdrawal.

The Guest also has the right to lodge a complaint with the supervisory authority — the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw — if they believe that the processing of their personal data violates the GDPR.

6. Voluntary Nature of Data Provision

Providing personal data is voluntary but necessary to make a reservation and to conclude and perform the rental agreement. Failure to provide the data makes it impossible to complete the reservation.

7. Automated Decision-Making

Guest personal data is not processed in an automated manner, including profiling, that produces legal effects concerning the Guest or similarly significantly affects them.

8. Controller's Obligations

  1. The Controller exercises due care to ensure that Guest personal data is not disclosed to unauthorized persons, and applies appropriate technical and organizational measures to this end.

  2. The Controller retains the right to disclose personal data to authorized entities (sub-processors) and in cases provided for by generally applicable law, in particular to online payment processors and front-desk software providers.

  3. The Controller is required to maintain the confidentiality of information obtained in connection with the reservation process. This obligation remains in force indefinitely.

9. Hotres.pl's Obligations

Hotres.pl, as a processor of Guest personal data under a data processing agreement concluded with the Controller pursuant to Article 28 GDPR, is required, in particular, to: implement appropriate technical and organizational measures ensuring a level of security appropriate to the risk of processing; encrypt the transmission of personal data; ensure the ongoing confidentiality, integrity, availability, and resilience of processing systems and services; be able to restore availability of personal data promptly in the event of a physical or technical incident; and regularly test and evaluate the effectiveness of the security measures applied.

FINAL PROVISIONS

The Controller is entitled to amend these Terms, in particular in the event of:

  1. the need to align the Terms with mandatory provisions of law or with changes to such provisions;

  2. the need to align the Terms with a recommendation, interpretation, ruling, order, or decision of a competent public authority or court affecting the content of the Terms;

  3. expansion or modification of Hotres.pl's functionality.

Amendments to the Terms do not affect the conditions of reservations made before the amendment's effective date, unless the amendment results from mandatory provisions of law.
